NOTICE: These Terms contain a binding arbitration clause and class action waiver in Section 11. By using the Service, you agree to resolve disputes through individual arbitration. You may opt out within 30 days as described in Section 11.9.

1. AGREEMENT TO TERMS
1.1 Binding Agreement
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Event Host," "Guest," or "you") and Selfish Software Ltd., a company registered in Israel ("Selfish," "we," "us," or "our").
1.2 Acceptance
BY CREATING AN ACCOUNT, CLICKING "I AGREE," UPLOADING CONTENT, OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS.
1.3 Capacity
You represent that you are at least 18 years old and have legal capacity to enter into these Terms.
1.4 Modifications
We may modify these Terms with 30 days' notice. Continued use constitutes acceptance.

2. THE SERVICE
2.1 Description
Selfish provides a platform enabling Event Hosts to upload event photos and use facial recognition technology to help Guests find their photos.
2.2 Platform Only
Selfish is a technology platform provider only. We do not create, own, or control User Content.

3. EVENT HOST OBLIGATIONS
3.1 Lawful Basis for Processing
As an Event Host, you represent and warrant that:
(a) You have obtained all legally valid consents from every identifiable individual depicted in photos you upload for the collection, storage, and processing of their image and biometric data.
(b) To the extent BIPA applies, you have obtained a written release from each individual as required by 740 ILCS 14/15(b).
(c) To the extent GDPR applies, you have a valid legal basis under Article 6 and Article 9 for biometric data.
(d) To the extent CCPA applies, you have provided required notices and honor consumer rights.
(e) You comply with all applicable privacy laws in any jurisdiction where individuals in your photos are located.
3.2 Children and COPPA
You will not upload photos of children under 13 without verifiable parental consent. You are solely responsible for COPPA compliance.
3.3 Prohibited Content
You will not upload content that you lack rights to upload, violates any person's rights, is illegal, or contains malware.
3.4 Account Responsibility
You are solely responsible for all actions taken through your account.

4. GUEST TERMS
4.1 Consent to Biometric Processing
By uploading a selfie, you provide explicit consent for Selfish to create a temporary biometric identifier from your facial geometry, compare it against event photos, and immediately delete your selfie and biometric data after matching.
4.2 Immediate Deletion
Guest selfies and temporary faceprints are immediately and permanently deleted after matching. There is no data to access or delete after your session.

5. SUBSCRIPTION AND PAYMENT
5.1 Billing
Subscriptions are billed in advance on a recurring basis.
5.2 Cancellation
You may cancel at any time. Your subscription remains active until the end of the current billing period.
5.3 No Refunds
We do not provide pro-rated refunds or credits for partial subscription periods or unused features.

6. INTELLECTUAL PROPERTY
6.1 Selfish Property
The Service and all related intellectual property are owned by Selfish.
6.2 User Content License
You retain ownership of your content. By uploading, you grant Selfish a license to host, process, and display your content as necessary to provide the Service.

7. DISCLAIMERS
7.1 "AS IS" Service
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY.
7.2 Facial Recognition Accuracy
We do not guarantee accuracy of facial recognition. False positives and false negatives may occur.

8. LIMITATION OF LIABILITY
8.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELFISH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
8.2 Cap on Liability
SELFISH'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: THE FEES YOU PAID IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100).

9. INDEMNIFICATION
9.1 Your Obligations
You agree to indemnify and hold harmless Selfish from any claims arising from: your User Content; your failure to obtain required consents (including BIPA, GDPR, CCPA, or COPPA); your breach of these Terms; or your violation of any law.
9.2 Cost Advancement
You agree to reimburse Selfish for legal defense costs as incurred if Selfish is named in any proceeding resulting from your actions or content.

10. FORCE MAJEURE
Selfish is not liable for failures or delays due to causes beyond reasonable control, including natural disasters, government actions, third-party service failures, or cyberattacks.

11. DISPUTE RESOLUTION
11.1 Informal Resolution
Before arbitration, contact info@selfish-events.com to attempt informal resolution within 60 days.
11.2 Binding Arbitration
Any dispute shall be resolved through binding individual arbitration, except for small claims court matters or intellectual property disputes seeking injunctive relief.
11.3 Arbitration Rules
Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.
11.4 Location
For US residents: your county of residence or remotely. For non-US residents: Tel Aviv, Israel, or remotely.
11.5 Governing Rules
The Federal Arbitration Act governs this arbitration provision.
11.6 CLASS ACTION WAIVER
YOU AND SELFISH AGREE THAT EACH MAY BRING CLAIMS ONLY IN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
If this waiver is found unenforceable, the entire arbitration provision is void.
11.7 Jury Trial Waiver
By agreeing to arbitration, you waive your right to a jury trial.
11.8 Fees
For claims under $10,000, Selfish will reimburse your AAA filing fee if you prevail.
11.9 Opt-Out
You may opt out of arbitration within 30 days of first using the Service by emailing info@selfish-events.com with your name, account email, and statement that you opt out of arbitration.

12. GOVERNING LAW
12.1 For US Residents
These Terms are governed by the laws of the State of Delaware, USA.
12.2 For Non-US Residents
These Terms are governed by the laws of the State of Israel.
12.3 Jurisdiction
For disputes not subject to arbitration: US residents consent to Delaware courts; non-US residents consent to Tel Aviv, Israel courts.

13. GENERAL PROVISIONS
13.1 Entire Agreement
These Terms, Privacy Policy, and AI & Biometric Data Policy constitute the entire agreement.
13.2 Severability
If any provision is unenforceable, remaining provisions continue in effect.
13.3 Assignment
We may assign our rights without restriction. You may not assign without consent.
